This article sets out a new conception of ‘property as an asset of resilience’. Building on Fineman’s emphasis on ‘webs’ of resilience, and applying insights from Actor-Network Theory and Resilient Property Theory, we examine how the rhetorical claims asserted by owners and non-owners, individually and collectively, and the ways that law recognizes and endorses those claims, affect the production of property-as-resilience. Applying Fineman’s framework, we argue that the ‘embodiment’ and ‘embeddedness’ of human vulnerability is revealed by the necessary and inevitable (...) relationship we have with land, housing and place. Everyone—including homeless people—must ‘be’ somewhere (embodiment); however, it is our ability to access ‘assets of resilience’ through our social embeddedness in institutional structures and relationships that mitigates (or not) our experience and life opportunities. In this article we analyze the nature of real property as an asset of resilience, the consequences of exclusionary concepts of ownership for how resilience is allocated, and the implications for how we think and talk about ‘exclusion’ and ‘inclusion’ in property theories and property law. We consider the roles that states perform in the allocation of property as an asset of resilience: both directly, through the protection and enforcement of private property rights and official narratives about the nature of private property; and indirectly, as owners leverage the hinterland of privilege extended to ‘ownership’ and owners to deepen their own networks of resilience. The success of deep brain stimulation (DBS) for movement disorders and the improved understanding of the neurobiologic and neuroanatomic bases of psychiatric diseases have led to proposals to expand current DBS applications. Recent preclinical and clinical work with Alzheimer's disease and obsessive-compulsive disorder, for example, supports the safety of stimulating regions in the hypothalamus and nucleus accumbens in humans. These regions are known to be involved in addiction and overeating associated with obesity. However, the use of DBS targeting these areas (...) as a treatment modality raises common ethical considerations, which include informed consent, coercion, enhancement, threat to personhood, and manipulation of the reward center. Pilot studies for both of these conditions are currently investigational. If these studies show promise, then there is a need to address the ethical concerns related to the initiation of clinical trials including the reliability of preclinical evidence, patient selection, study design, compensation for participation and injury, cost-effectiveness, and the need for long-term follow-up. Multidisciplinary teams are necessary for the ethical execution of such studies. In addition to establishing safety and efficacy, the consideration of these ethical issues is vital to the adoption of DBS as a treatment for these conditions. We offer suggestions about the pursuit of future clinical trials of DBS for the treatment of addiction and overeating associated with obesity and provide a framework for addressing ethical concerns related to treatment. Essential skills and attitudes necessary for active citizenship need to be cultivated as early as prekindergarten. This exploratory study investigated if three and four-year olds could be actively engaged in social studies practices through inquiry learning in a school garden. Eleven children openly interacted and conducted personally-driven investigations on a daily basis in the school garden located on their playground over nine-months. Three interviews with children, teacher observation notes, and lesson plans were analyzed to discover whether NCSS preK-12 learning themes (...) (2010) for the social studies curriculum could be correlated with garden inquiries. Three prevalent NCSS themes surfaced from data analysis with Civic Ideals and Practices, People, Places, and Environments, and Time, Continuity, and Change being most prevalent. Results imply that working in a school garden through inquiry learning can foster the development of democratic competencies and thus, could be used to design C3 lessons for preschoolers in the garden. The tension between scientific openness versus secrecy has existed for centuries (Hull 1985). However, both academics and practitioners have recently argued that openness by private firms has many positive attributes. The purpose of this research effort is to review the extant literature on openness and to develop hypotheses regarding its impact on organizational outcomes. We then use a unique database to test the idea with 87 companies. Our findings are that openness is beneficial to the firm from a science, technological, (...) and financial perspective and, perhaps, to the employees from an ethical viewpoint. This is the first volume dedicated solely to the topic of epistemological disjunctivism. The original essays in this volume, written by leading and up-and-coming scholars on the topic, are divided into three thematic sections. The first set of chapters addresses the historical background of epistemological disjunctivism. It features essays on ancient epistemology, Immanuel Kant, J.L. Austin, Edmund Husserl, and Ludwig Wittgenstein. The second section tackles a number contemporary issues related to epistemological disjunctivism, including its relationship with perceptual disjunctivism, radical skepticism, (...) and reasons for belief. Finally, the third group of essays extends the framework of epistemological disjunctivism to other forms of knowledge, such as testimonial knowledge, knowledge of other minds, and self-knowledge. Epistemological Disjunctivism is a timely collection that engages with an increasingly important topic in philosophy. When ethics committees are consulted about patients who have or need court-appointed guardians, they lack empirical evidence about several common issues, including the relationship between guardianship and prolonged, potentially medically unnecessary hospitalizations for patients. To provide information about this issue, we conducted quantitative and qualitative analyses using a retrospective cohort from Veterans Healthcare Administration. To examine the relationship between guardianship appointment and hospital length of stay, we first compared 116 persons hospitalized prior to guardianship appointment to a comparison group (n (...) = 348) 3:1 matched for age, diagnosis, date of admission, and comorbidity. We then compared 91 persons hospitalized in the year following guardianship appointment to a second matched comparison group (n = 273). Mean length of stay was 30.75 days (SD = 46.70) amongst those admitted prior to guardianship, which was higher than the comparison group (M = 7.74, SD = 9.71, F = 20.75, p. (shrink)

We provide an overview of a transdisciplinary project about sustainable forest management under climate change. Our project is a partnership with members of the Menominee Nation, a Tribal Nation located in northern Wisconsin, United States. We use immersive virtual experiences, translated from ecosystem model outcomes, to elicit human values about future forest conditions under alternative scenarios. Our project combines expertise across the sciences and humanities as well as across cultures and knowledge systems. Our management structure, governance, and leadership behaviors have (...) both fostered and constrained our work and must be continuously responsive to changing group dynamics. Our project presents opportunities for substantial contributions to society, including insights and knowledge about complementary ways of knowing, skills training, and professional development, and opportunities for reflexive learning about effective transdisciplinary, translational, and transformative scientific processes. Perception is not an independent, in‐the‐moment event. Instead, perceiving involves integrating prior expectations with current observations. How does this ability develop from infancy through adulthood? We examined how prior visual experience shapes visual perception in infants, children, and adults. Using an identical task across age groups, we exposed participants to pairs of colorful stimuli and implicitly measured their ability to discriminate relative saturation levels. Results showed that adult participants were biased by previously experienced exemplars, and exhibited weakened in‐the‐moment discrimination between (...) different levels of saturation. In contrast, infants and children showed less influence of memory in their perception, and they actually outperformed adults in discriminating between current levels of saturation. Our findings suggest that as humans develop, their perception relies more on prior experience and less on current observation. (shrink)

I write here about how the visible and the invisible intertwine in painting: in theory and in praxis – primarily the praxis of my own painting. Philosophers are rarely asked to discuss, much less to show in public, what they do avocationally rather than professionally. I was drawn to the invitation of the Merleau-Ponty Circle to exhibit my painting and to talk about what I do when I am not writing or teaching philosophy. It has offered a rare chance to (...) catch up with myself – with the painter in me. I started in art long before I turned to philosophy. It was my first love and is still my intermittent passion. I have not hidden it from others altogether – I have shown my work in various group shows– but it would be more accurate to say that I have hidden it from myself. Talking about my art work in the context of this Circle comes at a very welcome moment in which I am in the process of determining where I shall go with the rest of my life as it shortens down: ars longa, vita brevis.J’écris ici à propos de la manière dont le visible et l’invisible s’entrelacent dans la peinture : en théorie et en pratique, prioritairement dans ma propre pratique de la peinture. Bringing together the worlds of photography, geography, and philosophy to create an interdisciplinary theoretical understanding of place in relation to photography, Shobeiri has expertly unearthed a nuanced, exciting way of considering the photographic process and images.Shobeiri, an Assistant Professor of Photographic Studies and Visual Arts Theory at Leiden University, brings his knowledge and expertise of visual culture, photographic theory, human geography, and philosophy to the fore in his latest publication. His knowledge, passion, personal interest in photography, and his critical thought come through nicely in his writing, and it is clear that the development of Shobeiri’s ideas and framework have been given a lot of thought, time, and energy. This book meaningfully speaks to those interested in a discussion of place within the realm of photography, evidenced through the depth of knowledge and sheer detail explored within this book.Inspired by his own experience as a photographer and influenced by Edward Casey’s “delimited” definition of place, Shobeiri explores how place is never simply presented or fixed (11). It is here that he expertly uses photography to do this across six different yet clearly complimentary chapters. Critically, there is no way to give a succinct overview of the chapters of this book without losing meaning and diluting Shobeiri’s message; the book is rich, deeply detailed, embedded within philosophical thought, and is nuanced throughout, which is important to remember when reading this non- fiction piece of work.In the first chapter, Shobeiri provides a phenomenological exploration of the importance of the photographer’s body both as a lived experience and a physical entity. He then juxtaposes this duality to the lived [End Page 136] place of the photograph, returning to the notion of fixedness and using the idea of belonging to explore the photographer’s body and the photographic experience as a lived place. The next chapter discusses spatiality and time, and the way in which space is temporalized, using key influences such as Roland Barthes and Susan Collins to illustrate the argument. Central to this is the idea that a photograph captures time, but also aims at space, which raises questions about what this means for the space before the lens. In chapters 3 and 4, the author argues that the photograph itself travels through space, and highlights the importance of the photographic place, allowing us to “bestow meaning upon that space on the photograph’s surface” (67). Interestingly, Shobeiri points to philosophy to help the reader understand this, such as Jacques Derrida, and uses more familiar images and scholarly thought from NASA to discuss blind field and the liminality of photographic place. Chapter 5 moves away from location and journeys the reader to a discussion of places viewed as moment of encounter, specifically considering the spectator and the photograph. This evolves further in the sixth and final chapter insofar as it explores the transition and translation of the photographed place to the communication of the content of the image and the agency of the photograph. Shobeiri finishes with a simple yet engaging epilogue, several helpful notes, and a plethora of references which are useful for further reading.Place: Towards a Geophilosophy of Photography is genuinely interesting, centred within academic scholarship, and employs the thought of theorists that readers of Environment, Space, Place will undoubtably recognise. Scholarly figureheads such as Jacques Derrida, Alain Badiou, and Michel Foucault, space and place authorities such as Tim Cresswell, Tim Ingold, and Doreen Massey, and art aficionados such as Roland Barthes, Susan Collins, and John Berger frequent the pages. Familiar artistic names are also drawn upon, including Ansel Adams, Gert Jan Kocken, and Gerhard Richter, which soften the strong academic tones that this book voices. Reports of the Intergovernmental Panel on Climate Change (IPCC) employ an evolving framework of calibrated language for assessing and communicating degrees of certainty in findings. A persistent challenge for this framework has been ambiguity in the relationship between multiple degree-of-certainty metrics. We aim to clarify the relationship between the likelihood and confidence metrics used in the Fifth Assessment Report (2013), with benefits for mathematical consistency among multiple findings and for usability in downstream modeling and decision analysis. Gyula Klima maintains that Anselm's ontological argument is best understood in terms of a theory of reference that was made fully explicit only by later medievals. I accept the interpretative claim but offer here two objections to the argument so interpreted. The first points up a certain ambiguity in Klima's formulation of the argument, the correction of which requires a substantive revision of the argument's conclusion. The second exploits the notion of semantic closure introduced by Tarski. Klima offers the atheist (...) an ?out? by drawing a distinction between constitutive and parasitic reference. I argue that using Klima's preferred description (?the thought object than which no thought object can be thought to be greater?) to refer constitutively to God results in conceptual closure, a condition analogous to semantic closure that renders the instant conceptual scheme inconsistent and subject to paradox. Although the proof ultimately fails, Klima's development of the notions of constitutive and parasitic reference has important and far-reaching implications. (shrink)

Since the development of assisted reproductive technologies, infertile individuals have crossed borders to obtain treatments unavailable or unaffordable in their own country. Recent media coverage has focused on the outsourcing of surrogacy to developing countries, where the cost for surrogacy is significantly less than the equivalent cost in a more developed country. This paper discusses the ethical arguments against international surrogacy. The major opposition viewpoints can be broadly divided into arguments about welfare, commodification and exploitation. It is argued that the (...) only valid objection to international surrogacy is that surrogate mothers may be exploited by being given too little compensation. However, the possibility of exploitation is a weak argument for prohibition, as employment alternatives for potential surrogate mothers may be more exploitative or more harmful than surrogacy. It is concluded that international surrogacy must be regulated, and the proposed regulatory mechanism is termed Fair Trade Surrogacy. The guidelines of Fair Trade Surrogacy focus on minimizing potential harms to all parties and ensuring fair compensation for surrogate mothers. (shrink)

Avant de s’appuyer sur l’œuvre heideggérienne pour répondre aux questions peu examinées par cette tradition de pensée, l’A. décrit brièvement la manière dont certains des représentants de celle-ci — Siedel, Zimmerman et Foltz notamment — se servent de celle-là pour mieux saisir la position de l’homme dans la nature. À l’en croire, son but est double : utiliser d’abord la critique phénoménologique de la métaphysique établie par Heidegger pour montrer comment, au sein de cette dernière, notre compréhension de l’être a mené à une destruction de l’environnement, puis penser avec Heidegger pour chercher à ce problème une réponse post-métaphysique qu’il s’agirait d’esquisser si tant est qu’il y en ait une. In the heart of southeast Texas, an industrial powerhouse often referred to as the 'Golden Triangle', the oil refineries and petrochemical plants stand as stalwart testaments to the region's economic evolution. Interestingly, before the discovery of oil at Spindletop, the lumber and cattle industries powered this region's economy. A profound shift occurred when the Lucas Gusher, a fountain of oil spurting thousands of feet into the air, struck the lands of Spindletop Hill on January 10, 1901. This remarkable discovery of (...) the Spindletop oilfield on a slat dome formation south of Beaumont, Texas, marked the birth of the modern petroleum industry and fundamentally transformed the region's geopolitical, economic, and cultural landscapes. People from all over the country relocated to Gladys City and Beaumont in search of work and new opportunities, creating a boomtown as the town's population swelled from 10,000 to 50,000. The newfound urbanization brought by the oil industry transformed the town and the surrounding areas, creating a ripple effect across the region that would be felt for generations to come. The surge in oil-driven economic activity transmuted the region into a vibrant nexus of commerce, with the oil industry emerging as a critical architect of growth and advancement. This newfound affluence incited by the petroleum sector ushered in an era of economic diversification, laying the groundwork for industrialization’s further evolution. The Spindletop Oil Fields not only underscored the United States’ ascent as the foremost petroleum-producing nation but also signaled the nation’s initiation into the Petroleum Age. It was Spindletop that solidified its position as America’s first significant oil field, becoming an enduring symbol of its industrial might. By 1985, over 153,000,000 barrels of oil had been produced and extracted from the Spindletop oil fields, underscoring the magnitude of this extraordinary resource. (shrink)

Aristotle's definition of time as 'a number of motion with respect to the before and after' has been branded as patently circular by commentators ranging from Simplicius to W. D. Ross. In this book Tony Roark presents an interpretation of the definition that renders it not only non-circular, but also worthy of serious philosophical scrutiny. He shows how Aristotle developed an account of the nature of time that is inspired by Plato while also thoroughly bound up with Aristotle's sophisticated (...) analyses of motion and perception. When Aristotle's view is properly understood, Roark argues, it is immune to devastating objections against the possibility of temporal passage articulated by McTaggart and other 20th century philosophers. Roark's novel and fascinating interpretation of Aristotle's temporal theory will appeal to those interested in Aristotle, ancient philosophy and the philosophy of time. (shrink)

During the debates about the legalization of Voluntary Assisted Dying in Victoria, Australia, the presence of anti-VAD health professionals in the medical community and reported high rates of conscientious objection to VAD suggested access may be limited. Most empirical research on CO has been conducted in the sexual and reproductive health context. However, given the fundamental differences in the nature of such procedures and the legislation governing it, these findings may not be directly transferable to VAD. Accordingly, we sought to (...) understand how CO operates in the context of VAD. Prior to the implementation of the VAD legislation in June 2019, we conducted semi-structured interviews with seventeen health professionals with a self-declared CO to VAD, to explore what motivated their CO. Participants identified multiple motivations, which can be broadly categorized as: concerns for oneself; concerns for patients; concerns about the current Victorian legislation; and concerns for the medical profession. Participants’ moral commitments included personal, professional, and political commitments. In some cases, one’s CO was specific to Victoria’s current legislation rather than VAD more broadly. Our findings suggest CO motivations extend beyond those traditionally cited and suggest a need to better understand and manage CO in the healthcare context. (shrink)

Through extensive training, experts acquire specialized knowledge and abilities. In this paper, I argue that experts also acquire specialized visual experiences. Specifically, I articulate and defend the account that experts enjoy visual experiences that represent gestalt properties through perceptual learning. I survey an array of empirical studies on face perception and perceptual expertise that support this account. I also look at studies on perceptual adaptation that some might argue present a problem for my account. I show how the data are (...) subject to an interpretation that is friendly to it. Urban infrastructures serve as the backbone of modern economies, mediating global exchanges and responding to urban demands. Yet, our comprehension of these complex structures, particularly within diverse socio-political terrain, remains fragmented. In bridging this knowledge gap, this study delves into “boundary objects”—entities enabling diverse stakeholders to collaborate without a comprehensive consensus. Central to our investigation is the hypothesis that oceanic infrastructural developments are instrumental in molding the interface of urban, industrial, and energy sectors within marine contexts. Our lens is directed (...) at the Gulf of Mexico, which is distinguished by its industrial depth and expansive marine grid. We highlight the Gulf Intracoastal Waterway’s (GIWW) paramount role in regional movement and the ecological facets of practices such as dredging, which is vital for transport and coastal conservation. A striking revelation of our study is the transformation of offshore structures in the Gulf into vibrant marine habitats. Emphasizing the intertwined nature of marine infrastructures, we denote oceans as pivotal platforms for impending urban expansion, especially as land resources wane. I argue that the debates over which norm constitutes assertion can be abandoned by challenging the three main motivations for a constitutive norm. The first motivation is the alleged analogy between language and games. The second motivation is the intuition that some assertions are worthy of criticism. The third is the discursive responsibilities incurred by asserting. I demonstrate that none of these offer good reasons to believe in a constitutive norm of assertion, as such a norm is understood in the (...) literature. Others who have made similar arguments conclude that assertion does not exist at all—that there is no such thing as assertion. I disagree: we do not have to relinquish the category of assertion just because it is not normatively constituted. There are alternative ways to understand and individuate assertion that do not rely on a constitutive norm. (shrink)

Educators are increasingly concerned with the use of artificial intelligence (AI) in student writing. Much of the concern focuses on the issue of students using ChatGPT to complete their work. I introduce the CUPID model for instructors to use when thinking about how to pedagogically handle ChatGPT. The CUPID model lays out five general approaches: Catch, Utilize, Prevent, Ignore, and Disincentivize. I suggest that instructors should especially consider using certain assignments that fall under the approach “Disincentivize”. Philosophy instructors in particular (...) should assign more low-stakes writing, such as journals and reflection pieces. The adoption of low-stakes writing assignments aims to discourage students from relying on AI while promoting clarity of thought and deeper engagement with philosophical ideas. (shrink)

Kriegel has recently developed an adverbial account of intentionality, in part to solve the problem of how we can think of non-existents. The view has real virtues: it endorses a non-relational conception of intentionality and is ontologically conservative. Alas, the view ultimately cannot replace the act-object model of intentionality that it seeks to, because it depends on the act-object model for its intelligibility at key points. It thus fails as a revisionistic theory. I argue that the virtues of adverbialism can (...) be had from within the act-object framework, provided we understand intentional objects correctly. I use Crane as a guide here, and build on his work on intentional objects. In the end, we can provide a suitable solution to the problem of thinking of non-existents within the act-object framework without adopting implausible ontological or metaphysical views.
